Das Gesetz erlaubt es Geheimdienstmitarbeitern, Telefongespräche oder E- Mails im und Ausland, die über US-Kommunikationssysteme laufen, ohne vorherige gerichtliche Genehmigung abzuhören. Die Regelung soll nach einem halben Jahr auslaufen und muss dann erneut die Zustimmung im Kongress bekommen.

In the case ACLU vs NSA the judge agreed that the surveillance-program collided with the first and fourth amendment of the US-Constitution and the Seperation of Power Doctrine and was therefore illegal as long as the NSA doesn't get a judge's permission to observe and spy on a specific person or organisation.
